Bibcheck Terms of Service Agreement
The following Terms of Service (“TOS”) agreement governs the use of all Bibcheck bibliography formatting services ("Service"). BY CONTINUING TO ACCESS THIS CONTENT, YOU ARE INDICATING YOUR AGREEMENT TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE, BIBCHECK IS NOT WILLING TO PROVIDE YOU WITH ACCESS TO THE CONTENT, AND YOU SHOULD IMMEDIATELY DISCONTINUE YOUR ACCESS TO THIS CONTENT AND SERVICE. These rules may be modified from time to time. Your continued access to this Service will constitute your acceptance of any and all changes or revisions to the TOS. Your failure to follow these rules, whether listed below or in bulletins posted at various points in the Service, may result in the suspension or termination of your access to the Service, without notice, in addition to the Service Provider's other remedies.
COPYRIGHT
All information, content, Service, and software displayed on, transmitted through, or used in connection with Bibcheck, including, for example, news articles, reviews, directories, guides, text, photographs, images, illustrations, audio clips, video, html, source and object code, bibliographies, works cited, references, trademarks, logos, and the like (collectively, the "Content"), as well as its selection and arrangement, is owned by Bibcheck, Paper-Check.Com, LLC, and its affiliated companies, licensers, and suppliers.
You agree not to decompile, reverse engineer, or disassemble any software, source code, or processes accessible through Bibcheck or http://www.bibcheck.com. You further agree not to insert any code or product or manipulate the content and/or source code of Bibcheck in any way that affects the user's experience or replicate an unauthorized version of this Content or Web site, which directly or indirectly competes with Bibcheck.
SERVICE LIMITATIONS
Bibcheck is a bibliographic building application. Bibcheck is in BETA, and does not guarantee the accuracy of the bibliographic entries until the BETA label has been removed. Engineers are constantly updating the source code and, from time-to-time, you may experience outages.
FEES
Establishing a Bibcheck account is free, and you may use Bibcheck for free without establishing an account. If you open a Bibcheck account, you will be able to save your work cited, references, and bibliography pages. You may also modify the entries once you have created them. If you use our bibliography builder without creating an account, you will not be able to modify your entries once they have been created. Bibcheck will remain free while in BETA, but we reserve the right to charge a subscription fee once the Web site has been completed.
TRADEMARKS
This TOS does not grant you any rights in connection with any trademarks or service marks of licenser or its suppliers.
TERMINATION
Bibcheck may terminate this TOS and your access to and use of Content or any portion thereof, immediately, on the basis of its sole discretion, at any time without cause.
JURISDICTION
The laws of the State of California shall EXCLUSIVELY govern this TOS. Venue for any mediation, litigation, special proceeding, or other proceeding as between the parties that may be brought or may arise out of, in connection with, or by reason of this Agreement shall be in San Francisco County, California.
ENTIRE AGREEMENT
This TOS agreement supersedes any prior agreements, oral or written, between you and Bibcheck with respect to such content. You also may be subject to additional terms and conditions that may apply when you access content or services provided by entities other than Bibcheck on the Web site from which you are accessing this Agreement or when you access any content provided by Bibcheck from a Web site other than the one from which you are accessing this Agreement.
Bibcheck is the property of Paper-Check.Com, LLC. You do not need to have a Papercheck account to use Bibcheck, or http://www.bibcheck.com. All rights not specifically stated in this Terms of Service agreement will remain the property of Bibcheck and Paper-Check.Com, LLC. The failure of Bibcheck or Paper-Check.Com, LLC to exercise or enforce any right or provision of this TOS shall not constitute a waiver of such right or provision.
